LIABILITY WAIVER

I ("I", "me", "Participant"), have elected, on a voluntary basis, and, if I am under the age of 18, with the acknowledgement and permission of my parents or legal guardians (individually and collectively referred to herein as "Guardian"), to participate in dance and other athletic performance-related activities
(individually and collectively, "Activities") for which I am registered with DA Ballet Academy LLC (Hollywood Ballet Academy ) which may include, without limitation, participation in DA Ballet Academy LLC ( Hollywood Ballet Academy ) Classes and/or events to be named subsequent to the date hereof
(individually and collectively, "Events").
I and my Guardian hereby represent and warrant that: (i) I am aware that participation in the Activities presents certain risks, (including, without limitation, brain injury, severe bodily harm and/or death) and I am aware that equipment problems and human error can contribute to or cause such injuries; (ii) I am
aware that my risk of injury may be increased if I suffer from conditions that may be affected by physical exertion, and I represent and warrant that I am in good health and do not suffer from any such condition(s) (including, but not limited to neck, back, heart problems and pregnancy); (iii) no representations of any kind have been made to me by Company or Company's employees or personnel regarding my ability to participate in the Activities; and (iv) my participation in the Activities is not
employment and is not subject to any union or collective bargaining agreement, and does not entitle me to wages, salary, corporate benefits, unemployment or workers' compensation benefits, or other compensation. I knowingly and voluntarily assume all risks associated with the Activities, and I and my
Guardian unequivocally agree to incur and assume such risks as a condition to my participation in the Activities. I represent and warrant that I have reviewed this waiver ("Waiver") with my Guardian and I have obtained the permission of my Guardian to enter into this Waiver, as evidenced by my Guardian's signature/s. I and my Guardian agree and acknowledge that this
Waiver is applicable to all Company Classes, Events and all Activities in which I participate at any time, and is a perpetual Waiver for all such Classes, Events and Activities.
I understand that Company from time to time produces audio-visual programs, promotions, and other materials relating to its Classes, Events, Activities, and Services. I and my Guardian hereby grant Company and its agents, successors, assigns and licensees the perpetual right to use my name, likeness, biographical information, photographs, voice, personal characteristics, and other personal identification (collectively "Likeness") and any digital, videotape, sound and audio-visual recordings in any way (collectively "Recordings") in any and all manner and media, now known or hereafter devised,
throughout the world, for any and all purposes including, without limitation, in productions and in connection with the advertising and promotion of productions and/or Company, provided that Company is under no obligation to exercise any of the foregoing rights.
In order to induce Company to register Participant in Company's Classes, Events, Activities and in consideration for Participant's opportunity to participate in the Activities, I and my Guardian hereby waive all claims (past, present or future), release and discharge, covenant not to sue, and agree to indemnify and hold harmless Company and all of its sponsors and advertisers, all venues at which the Classes and Events are held, all other persons and entities connected with the Events, the respective
parents, subsidiaries, affiliated entities, licensees, successors and assigns of each of the foregoing, and each of their respective directors, officers, employees, agents, contractors, partners, shareholders, representatives and members, and each of their respective heirs, next of kin, spouses, guardians, legal
representatives, executors, administrators, successors, licensees and assigns (individually and collectively, the "Releasees"), in advance from and against any and all liability, loss, cost, damages, expense, claims, demands, actions, judgments and executions (individually and collectively, "Claims") which I and my Guardian, and my and my Guardian's heirs, representatives, administrators, executors, and assigns (the "Releasing Parties"), ever had, now has, or may have in the future, known or unknown, for loss or injury including, without limitation, personal injuries, bodily injury, death, lost wages, loss of employment, infliction of emotional distress, and/or damage to property (real or personal) in any way caused by, related to, or arising out of, directly or indirectly, the Releasing Parties' participation in the Activities and/or presence at the Classes, Events, including, without limitation, Claims arising from any
defect or failure in or of equipment, venues, warnings, instructions, or otherwise, and/or arising from the
Releasees' or any third parties' negligence or carelessness and/or the use of my Likeness, including but
not limited to defamation, invasion of privacy, infringement of rights of publicity, misappropriation, false light, copyright or trademark infringement. I and my Guardian understand the significance and consequence of, and agree that, all rights under Section 1542 of the Civil Code of Florida or any similar
law are hereby expressly voluntarily waived in full by me. Section 1542 states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor." I and my Guardian shall not be entitled for any reason to terminate or rescind this Waiver nor to enjoin, restrain or otherwise impair the exercise of any of the rights and
privileges granted or to be granted to Company hereunder, nor to restrain, enjoin or otherwise impair the development, production, exhibition and/or exploitation of the Classes, Events.
AGREEMENT FOR PARTICIPATION
I understand that dance classes may include, without limitation, dancing with props, stretching, barre work, across the floor combinations, dance routines in the center, and other related activities. I further understand that all the activities of the dance class involve some degree of risk of strain or bodily injury.
DA Ballet Academy LLC ( Hollywood Ballet Academy ) is not responsible for personal property. I agree to be responsible for reading studio correspondence and respecting deadlines, if applicable. I hereby acknowledge that I have read the statements above and agree to participate accordingly.
IN CASE OF EMERGENCY, I and my Guardian authorize Company and Company's agents, employees, representatives, and contractors, to arrange for or provide such medical assistance to me as any of them deems necessary, and authorize any physician, other medical or paramedical provider, and any
medical facility to provide medical or surgical care, including without limitation anesthetization and hospitalization, which any of them may determine to be necessary or advisable, pending receipt of a specific consent from me. If my condition renders me incapable (as determined by Company and/or medical provider) of providing a specific consent at the time that medical provider present determines any treatment to be necessary and/or advisable in such the medical provider's sole discretion, I and my Guardian authorize such provider to administer such treatment without the need for further consent. I and my Guardian acknowledge that I will be responsible for paying for any medical treatment that I may receive as a result of injuries or illness suffered during my attendance and/or participation in the Events and Activities.
This Waiver shall be interpreted under the internal, substantive laws of the State of Florida without regard to the conflicts of law provisions thereof. The illegality, invalidity or unenforceability of any provision hereof shall in no way affect the validity or enforceability of any of the remainder of this Waiver,
which shall be enforced to the maximum extent permitted by law. I and my Guardian acknowledge that I and my Guardian have read every paragraph of this Waiver and understand each paragraph completely. I and my Guardian freely and voluntarily agree to all of the terms contained herein and understand that I
and my Guardian are giving up certain legal rights.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Hollywood Ballet Academy has been following the Center for Disease Control and Prevention (CDC), and state and local officials on guidelines as well as following best practices with ballet schools operating in person across the nation.
Hollywood Ballet Academy has put into place these preventive measures to reduce the spread of COVID-19; however we cannot guarantee that you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while utilizing Hollywood Ballet Academy, services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize Hollywood Ballet Academy services and/or enter onto Hollywood Ballet Academy premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
By reading these Guidelines and adhering to the practices outlined in the guidelines you understand the risk and contagious nature of COVID-19. By signing this release you acknowledge you or your child’s risk of being exposed to or infected by COVID-19 by attending classes at Hollywood Ballet Academy. This exposure may result from the actions, omissions, or negligence of the studio, and others, including but not limited to, faculty, staff, and students and their families.
READ CAREFULLY AS EXECUTION OF THIS FORM WILL WAIVE LEGAL RIGHTS:
I understand that Hollywood Ballet Academy has implemented the enhanced safety and sanitation protocols in response to
COVID-19. I further acknowledge and understand that, even in light of these procedures, there is still a risk that my child, or I,
participating in classes at Hollywood Ballet Academy can contract COVID-19 while on premises or off premises as a result of traveling in the state. I also acknowledge that due to their physical nature, dance programs may carry a greater risk than other activities of exposure to COVID-19. Even when all reasonable precautions are taken, there is an unavoidable risk of exposure to COVID-19.
I knowingly and voluntarily agree to assume all the risks of COVID-19 and accept sole responsibility of any infection (including but not limited to personal injury, disability, and death) or expense of any kind, that I or my child may experience or incur
during my, or my child’s attendance at classes at Hollywood Ballet Academy.
Student and his/her assignees, heirs, parents, guardians, and legal representatives hereby voluntarily release, forever
discharge, and hold harmless Hollywood Ballet Academy, and each of their officers, trustees, employees, faculty, staff,
students, agents, representatives, or groups affiliated therewith (collectively) from any liability, claims, or causes of action of
whatever nature, arising from or related to exposure to COVID-19 for any reason whatsoever to the fullest extent permitted by
law, including without limitation the negligence of Hollywood Ballet Academy.
I acknowledge by signing this release that I have read and understand Hollywood Ballet Academy Health and Safety Guidelines.
I also understand that any COVID-19 infection (whether it occurs before, during, or after participation in classes) and any
related claims will not be directed to Hollywood Ballet Academy or their employees or agents. By signing this release, Student
and his/her assignees, heirs, parents, guardians, and legal representatives waive the right to bring any legal action now or at any time in the future to recover compensation or obtain any other remedy for any injury to Student or Student’s property—
including his/her death—caused by COVID-19 or COVID-19-related procedures and arising out of his/her participation in the
Program. I also understand that Student will not be able to participate in the program unless this document is signed with
acknowledgement of understanding of the risks involved.
In addition, I understand that this release is intended to be as broad and inclusive as the State of Florida will allow and that if
any portion is held invalid, agrees that the balance shall, not withstanding, continue in full force and effect.

If participant is under 18 years old, parent must sign.

WINTER/SUMMER INTENSIVE AGREEMENT
Dear Student(s) attending our Winter/Summer Intensive,
Congratulations on choosing to participate in world-class training this year with Hollywood Ballet Academy. It takes a very serious commitment and understanding of ballet training to select Hollywood Ballet Academy’s Winter/Summer intensive programs. We look forward to working with you, whether in person or virtually!
COURSE DESCRIPTION
Detailed study of classical ballet technique: providing an advanced and high level of training, connecting movement sequences musically and physically, creating combinations designed to develop control, balance, strength and flexibility, standard classical divertissement and style
distinctions, including progression of technical complexities and approaches to classical ballet stylizations. We are fine-tuning the physical understanding of classical ballet’s technical
expectations and the artistic aspect of the art form. We believe diligence, discipline, and a good work ethic are keys to success. We all come from different backgrounds in terms of natural,
physical abilities, and personalities. By applying yourself well, you will ultimately achieve your personal goal.
CLASSROOM EXPECTATIONS
Attendance:
Be on time for every class. Arriving 20 minutes after class begins will be considered “absent.”
Notify the teacher before class if you will be unable to attend any class.
Warm-up before class, so you’re ready for work when class begins. The barre portion of the class is not intended as a warm-up period.
Notify the teacher of any injury that may cause you to miss class or prevent you from finishing a class.
Appearance:
Hair should be up and out of your face, secured tightly - no loose ends (no ponytails).
No loose jewelry.
Warm-up clothes must be taken off when the class starts. Tight-fitting leg warmers may be worn if nursing an injury that the teacher is aware of.
Maintaining a healthy physique will help you prevent injuries.
A student must maintain a healthy, toned, and energized physique, one conducive to achieving the aesthetics necessary to express the art form through his/her body and meet the
physical demand from the vigor of the art form.
Ladies: You must be wearing a ballet leotard and tights (no sports bras and shorts).
Gentlemen: Solid Black-colored tights with dance belt and a tightly fitted T-shirt or
leotard. Shoes:
Ballet Slippers: Elastics should be SEWN onto shoes - not tied in a knot.
Pointe Shoes: Must have ribbons sewn on.
UNIFORM & CLASSES REQUIREMENTS
Ballet, PDD, Classical & Balanchine Variations, Repertoire:
We do not have a formal uniform for Winter/Summer Intensive at Hollywood Ballet Academy;
however, we ask that you make choices that are suited for classical ballet. Rehearsal Tutus can be worn for variations and Pas de Deux Classes.
Contemporary, Jazz, Afro-Cuban: Contemporary, Jazz, Afro-Cuban: Please wear other clothes over your class outfit to avoid sweat going all over the floors. Leggings, sweat pants, Tshirts
are allowed.
Character, Broadway, Ballroom, Flamenco: Please pack your Character Skirt, Character
Shoes, Ballroom Heels, and if you happen to have a Flamenco Skirt as well. Otherwise, you can wear your Rehearsal Skirt.
PBT, Floor Barre, Stretching & Conditioning: Students would need a Floor mat, exercise ball for your size (look up size chart in PBT) 55cm for most, fusion ball, lacrosse ball, roller, resistance band, Thera-band medium-strong preferable 2.7meters or 9ft, socks, towel and a bottle of water.
CLASSROOM ETIQUETTE
The instructor expects you to be focused physically and mentally so we may begin class with total physical and mental capacity.
Be very focused when you are given a combination.
Pay special attention to musicality.
Be open-minded to new ways of performing a step.
Be willing to explore new ideas about movement and music and learn to work through the unfamiliarity.
When given a correction, apply immediately. Work to retain this information so that you will be able to eliminate the issue in future classes.
When a classmate is given a correction, absorb it as though it was given to you.
If there is a question about something, wait until the instructor finishes explaining - your answer may be in the instructor's following words.
Prepare for each combination before the music starts. Don't wait for the introduction of the music to get into position.
Be motivated, energetic, and responsive to your teacher throughout the class.
When you encounter an obstacle, continue with a positive attitude. Never "give up" in the middle of a combination.
Trust that the instructor's experience and knowledge will help guide you toward improvement and success.
If you wish to discuss or question a correction or combination, the time to do this is after class. Not during. It interrupts the flow of the class and brings your classmates out of focus.
Treat the virtual studio as a sacred place: Respect the learning environment, no unnecessary talking, no gum chewing, respect and be courteous to your teacher, accompanist, and fellow
classmates and respect the art form of ballet.
SCHEDULES
Schedules are subject to change. In case of an emergency, please understand that teachers or types of classes can be changed. We will post schedules on a weekly basis. The first schedule will come out the week before the intensive. Stay tuned to our website for posting or changes.
Also, make sure to sign up for our Stay Connected program to receive automatic email notifications and not miss any changes or information from Hollywood Ballet Academy.
LEVELS
Levels have been pre-assigned by ages, and adjustments will occur under the discretion of the artistic director. Select students might be asked to cross into different levels based on specific needs due to technique, injuries, or repertory work.
FOOD
We strongly suggest packing food for the day, especially for the younger dancers. However, there are many restaurants in downtown Hollywood on Harrison St, where our school is located, and on Hollywood Blvd, all within five minutes walking distance. Please do not allow your child (the student) to go beyond Downtown Hollywood on foot; we are not a chaperoned intensive. If you authorized your child (the student) to go outside of our studios to get food on their own, you must sign an agreement. We have a small kitchen with a refrigerator, freezer, coffee machine, and microwave. Space can be limited, so use ice packs as well. Make sure to place your name on your lunch bag to avoid any confusion.
SCHOLARSHIPS
Artistic Scholarships at Hollywood Ballet Academy are awarded strictly for artistic merit and potentially talented students seeking a spot at Hollywood Ballet Academy. Given the sensitive
nature of these awards, please keep your award confidential. Please do not share this information with any other student, either verbally or on any form of social media.
COVID-19 POLICY (as of September, 2021)
CDC recommendations and local guidelines are changing rapidly. Therefore policy is subject to change at any time. At this time, we will require the use of facemasks for our Winter/Summer
Intensive. Based on the Florida State Policy, we are allowed to hold the event at this current time. If the situation changes, we will notify everyone once the state informs us. However, our
situation is different in a busy ballet studio with strenuous activity. Ballet requires such physical contact, and it’s our responsibility to keep everyone safe. If the pandemic situation changes over the year and masks are not required, one is always welcome to wear a mask if it feels comfortable for you.
Fully Vaccinated Participants: (meaning 2 weeks after complete dosage). Anyone who is vaccinated by the commencement of our event Winter/Summer intensive may show the vaccine
card at check-in. This does not excuse any dancer from mask requirements. It does excuse any dancer from quarantine requirements in case of exposure, as they can continue class unless symptoms are present. Covid tests must be done if experiencing symptoms.
Unvaccinated Participants: We require a negative RT-PCR or Rapid covid test that has been taken within 72 hours of arrival of your first day of taking the class. Negative tests can be shown
at check-in, printed out, or a picture/email on your phone.
Symptomatic Students: Please do not come to class if you are experiencing symptoms. Any symptomatic students over the course of the intensive will be asked to find a testing site and
produce a negative test before returning to class. Anyone who tests positive must follow current
CDC quarantine guidelines and medical recommendations before returning to class. We ask that you use caution while enjoying your time in South Florida. Your training is the priority; please use masks indoors in crowded areas as you enjoy your time in the Sunshine State. Also, take advantage of all the safe outdoor opportunities and wear your sunscreen.
